Under the provisions of the Public Procurement Act (PPA) 2006 and Public Procurement Rules (PPR) 2008, a tenderer may be considered ineligible for procurement of goods if the tenderer has been declared ineligible by the Government of Bangladesh, is involved in a conflict of interest, has engaged in corrupt, fraudulent, collusive, or coercive practices, lacks the legal capacity to enter into a contract, is bankrupt, insolvent, or under receivership, has been debarred by a development partner or international financing agency in donor-funded projects, has a record of poor performance or defective execution of previous contracts resulting in debarment, fails to meet the eligibility requirements specified in the tender document such as valid Trade License, TIN, VAT Registration Certificate and other statutory obligations, or, in the case of a government-owned enterprise, does not meet the conditions of legal and financial autonomy and operation under commercial law. Any tenderer found to have submitted false or misleading information may also be declared ineligible and disqualified from the procurement process.
